The Canada Border Services Agency (CBSA) has revised its timeline for implementing the mandatory Single Window Initiative (SWI), moving away from the original April 1st deadline in favor of a phased decommissioning approach. While the agency has not yet confirmed the new mandatory date, industry sources anticipate an October 2019 implementation.

Current Requirements for Trade Community

Despite the timeline adjustment, CBSA emphasizes that brokers and importers must continue using the Integrated Import Declaration (IID) system whenever possible. To encourage compliance, the agency is implementing immediate changes to service priorities:

· Priority processing for IID submissions through both CBSA and Canadian Food Inspection Agency (CFIA)

· Reduced service hours for legacy Other Government Department (OGD) service options on ACROSS (to be implemented soon by CFIA)

· Potential rejection of legacy OGD submissions starting July 2019 for transactions where IID functionality exists

Reasons for the Timeline Extension

The decision to extend the implementation period stems from:

  1. Unresolved technical issues requiring additional development time
  2. Significant feedback and concerns from the trade community

Updated Implementation Roadmap

CBSA has outlined the following phased approach:

  1. April 2019: Release of an ECCRD addendum detailing required system changes and fixes (full revised ECCRD to follow in June)
  2. Late April 2019: Deployment of technical fixes to CBSA’s test environment, allowing brokers and importers to conduct testing throughout spring and summer
  3. Fall 2019: Production implementation of all fixes (exact date to be confirmed)

The agency maintains its commitment to providing six months for trade adaptation to system changes.

Are You Prepared for Canada’s Updated Food Safety Requirements?

If you import or export food products, it’s crucial to stay informed about the proposed regulatory changes from the Canadian Food Inspection Agency (CFIA). These updates, part of the Safe Food for Canadians Regulations (SFCR), aim to modernize food safety standards, impacting businesses across the supply chain.

The 90-day public consultation period for these regulations closed on April 21, 2017, marking a significant step toward implementation. The SFCR introduces stricter requirements for businesses involved in importing, exporting, or interprovincial trade of food products, including sectors previously not federally regulated.

Who Will Be Affected?

The new regulations will apply to:
✔ Importers of food products
✔ Exporters shipping goods internationally
✔ Manufacturers & processors selling food across Canadian provinces
✔ Businesses in previously unregulated sectors, such as:

· Infant foods

· Spices & seasonings

· Bakery products

· Fats & oils

· Snack foods

· Cereal products

Key Changes Under the SFCR

1. Licensing Requirements

· Who needs a license?

Food importers

Businesses preparing food for export or interprovincial trade

Slaughterhouses processing animals for meat products in interprovincial/export trade

· License Details:

Valid for 2 years

Application fee: ~$250

Multiple licenses allowed per business

Non-compliance may result in suspension or cancellation

2. Enhanced Traceability Systems

Businesses must maintain one-step-forward, one-step-back traceability (following Codex international standards).

· Records Required:

Supplier information (immediate source)

Customer details (next recipient)

· Exemptions: Retailers selling directly to consumers

· Compliance Deadlines:

24 hours or less for urgent CFIA requests (e.g., health risks)

Records must be accessible in Canada in English or French

Electronic records must be compatible with standard software

3. Preventive Control Plans (PCPs)

Businesses must implement science-based safety measures, including:
✔ Sanitation & pest control
✔ Equipment & facility standards
✔ Proper storage & handling
✔ Employee hygiene & training
✔ Recall & complaint procedures

Additionally, commodity-specific rules (e.g., meat import approvals) will remain in place.

Next Steps for Compliance

Businesses should:

  1. Review the full SFCR proposal (Gazette Notice)
  2. Assess licensing needs
  3. Implement traceability & PCP systems
  4. Train staff on new hygiene & safety protocols

For more details, visit the CFIA’s Q&A page.

Stay compliant—start preparing today!

The Miscellaneous Tariff Bill (MTB) is a key piece of U.S. trade legislation designed to support domestic manufacturers and importers by temporarily reducing or suspending import tariffs on certain products. First introduced in the early 1980s, the MTB has evolved over time, with its latest procedural updates established under the American Manufacturing Competitiveness Act of 2016 (AMCA).

Key Objectives of the MTB

The MTB serves two primary purposes:

  1. Enhancing U.S. Manufacturing Competitiveness – By lowering import duties on essential inputs, the MTB helps U.S. manufacturers reduce production costs and remain competitive in global markets.
  2. Providing Technical Corrections to the HTSUS – The bill allows importers to request adjustments to the Harmonized Tariff Schedule of the United States (HTSUS) to ensure accurate classification of goods.

To qualify for inclusion in the MTB, product petitions must meet specific criteria:

· Non-controversial – No domestic opposition or competing U.S. production of the product.

· Minimal revenue impact – The duty suspension or reduction should not significantly reduce government revenue.

Regulatory Oversight & the MTB Process

Under the AMCA, the MTB process has been streamlined for greater transparency and efficiency. Key agencies involved include:

1. U.S. International Trade Commission (USITC)

· Collects and publishes product petitions.

· Facilitates public comment periods.

· Coordinates with the Department of Commerce (DOC) and other agencies.

· Issues preliminary and final reports to Congress.

2. Department of Commerce (DOC)

· Assesses domestic production availability and potential objections.

· Works with U.S. Customs and Border Protection (CBP) to verify product descriptions.

· Submits a report to congressional committees and the USITC.

3. Congressional Committees (Ways & Means, Senate Finance)

· Review USITC recommendations.

· Finalize the MTB before it becomes law.

Current Status of the 2017 MTB Process

The latest MTB cycle is progressing as follows:

· Oct 14 – Dec 12, 2016: USITC opened its portal for petition submissions.

· Jan 11 – Feb 24, 2017: Public comment period on submitted petitions.

· April 10, 2017: DOC submitted its report to the USITC, including:

CBP’s assessment of administrable product descriptions.

Identification of products potentially subject to anti-dumping (ADD) or countervailing duties (CVD).

Notable Trends in 2017 Petitions

While past MTBs focused mainly on raw materials and chemical inputs, the 2017 petitions include a broader range of products, such as:

·  Chemicals & plastics

· Leather goods & apparel

· Furniture & vehicle parts

· Meat & food products

Some critics argue that the inclusion of finished goods deviates from the MTB’s original intent of supporting manufacturing inputs.

Next Steps in the MTB Timeline

·  April – June 2017: USITC reviews DOC findings and submits a preliminary report.

·  June – August 2017: USITC re-evaluates petitions and issues a final report.

·  Late 2017: Congress passes the MTB, amending HTSUS Chapter 99, Subchapter II for up to three years.

The entire process takes approximately 300 days, with the next submission window opening no later than October 15, 2019.

How Businesses Can Benefit

· Importers should review the 2017 petitions list to identify potential duty savings.

· Manufacturers can assess whether their products qualify for future MTB cycles.

Modernizing Border Management Through SWI

Canada’s Single Window Initiative (SWI) represents a significant leap forward in trade facilitation, transitioning from concept to operational reality. Spearheaded by the Canada Border Services Agency (CBSA), this initiative addresses evolving challenges in border management, including:

· Rising trade volumes and new product categories

· Increasing regulatory requirements from Other Government Departments (OGDs)

· The shift toward paperless trade environments

· Balancing security and trade efficiency

Under the authority of the Customs Act, the CBSA collaborates with OGDs to control, detain, and share trade-related data—ensuring compliance while minimizing delays.

Key Benefits of the Single Window Initiative

1. Simplified Trade Reporting

The SWI standardizes data and simplifies processes, reducing administrative burdens for businesses. This aligns with commitments under the Canada-U.S. Beyond the Border Action Plan.

2. Enhanced Risk Management

By improving the identification of regulated goods and validating permits electronically, the SWI strengthens border controls while expediting legitimate trade.

3. Multi-Agency Coordination

The CBSA, along with nine OGD partners, enables importers and brokers to submit trade data once, with the CBSA routing information to the appropriate agency for assessment.
